General's Opinion Regarding the Commission's Jurisdiction
Over Common-Interest Communities’ & Condominium Hotels’
Governing Documents
Pursuant to a formal opinion of the Attorney General’s
Office, the Commission for Common-Interest Communities does
not have jurisdiction to investigate the interpretation,
application and/or enforcement of governing document
disputes nor does the Commission and its Administrative Law
Judges (ALJs) have jurisdiction to hear or decide governing
document disputes.
Currently, any party with a dispute regarding the
interpretation, application and/or enforcement of their
governing documents may use the Alternative Dispute
Resolution (ADR) program, a system which utilizes
arbitration and mediation. Parties who wish to know
more about the ADR process may contact the Office of the
Ombudsman at (702) 486-4480.
